STATEMENT OF FACTS
The applicants, Mr KreÅ¡imir Ivančić and Ms Å tefica D ž elajlija , are Croatian nationals, who were born in 1963 and 1960 respectively and live in Daruvar . They are represented before the Court by Mr J. Doneski , a lawyer practising in GareÅ¡nica .
The circumstances of the case
The facts of the case, as submitted by the applicants, may be summarised as follows.
On 11 May 1994 four members of Serbian para-military forces entered Batnjska Rijeka, a village in Croatia, and abducted eight persons of Croatian ethnic origin, including the applicants ’ father Zdravko Ivan č i ć . The applicant father was killed together with four other abducted persons while three of them, even though gravely wounded managed to escape.
The perpetrators were identified and indicted in the Bjelovar County Court. The criminal proceedings against them are still pending.
COMPLAINT
The applicants complain under the procedural aspect of Article 2 of the Convention about the inefficiency of the criminal law mechanisms as regards the killing of their father.
QUESTION TO THE PARTIES
Having regard to the procedural protection of the right to life, was the manner in which the criminal law mechanisms have been applied in the present case by the domestic authorities in breach of Article 2 of the Convention?
The Government are invited to submit copies of all case files and other documents concerning the killing of the applicants ’ father.
