Application no. 57849/13 Danijela LOVRIĆ and others against Croatia lodged on 3 September 2013

STATEMENT OF FACTS

The applicants, Ms Vesna Martinović and Ms Branislava Mikulandri ć are Croatian nationals and the applicant Ms Danijela Lovrić is a Serbian national. They are born in 1951, 1977 and 1970 respectively and live in Karlovac , Croatia.

The circumstances of the case

The facts of the case, as submitted by the applicants, may be summarised as follows.

The applicants ’ respective husband and father, Branko Martinovi ć was killed in 1991 in Karlovac , allegedly by Croatian soldiers.

COMPLAINTS

The applicants complain, without invoking any provision of the Convention, that the State authorities did not comply with their obligation to identify and punish the perpetrators.

QUESTION TO THE PARTIES

Having regard to the procedural protection of the right to life, was the manner in which the criminal law mechanisms have been applied in the present cases by the domestic authorities in breach of Article 2 of the Convention?

The Government are invited to submit copies of all case files and other documents concerning the killing of the applicants ’ relatives.
