Application no. 24587/13 Florin URZICA against Romania lodged on 8 April 2013

STATEMENT OF FACTS

The applicant, Mr Florin Urzica, is a Romanian national, who was born in 1969 and is currently detained in Rahova Prison.

The facts of the case, as submitted by the applicant, may be summarised as follows.

On 29 February 2012 the applicant was arrested on suspicion of theft and brought to the Bucharest police station. He alleges that he was beaten by policemen during his apprehension and at the premises of the police station for admitting that he had committed a theft .

The applicant submitted medical documents concerning his medical condition on the date of his arrest. They noted a facial traumatism with an important ecchymosis of the bone and an injury on his right leg. They also noted a cervical contusion. It was recommended that the applicant use a cervical collar for fourteen days.

The applicant also submitted a photograph showing him wearing a cervical collar in order to sustain his neck. His face was swollen and he had bruises under his eyes.

On 4 May 2012 the applicant brought criminal proceedings against the policemen who allegedly had beaten him. He claims that he did not receive any answer to his complaint. In order to obtain more information in this respect he sent letters to different state authorities.

According to a letter of 27 November 2013, sent by the Bucharest Court of Appeal to the applicant, it appears that his complaint had been registered with the Prosecutor ’ s Office attached to the Bucharest Court of Appeal but no fu rther information was provided.

COMPLAINT

The applicant complains under Article 3 of the Convention about the ill ‑ treatment to which he had been subjected on 29 February 2012 and the lack of an effective investigation.

QUESTIONS TO THE PARTIES

1 . Was the applicant subjected to inhuman or degrading treatment on 29 February 2012 in breach of Article 3 of the Convention?

2 . Having regard to the procedural protection from inhuman or degrading treatment , was the investigation of the present case by the domestic authorities in breach of Article 3 of the Convention?

The Government are asked to submit a copy of the full version of the case file concerning the criminal investigation.
