Application no. 75982/13 Daniel Liviu LITAN against Romania lodged on 26 November 2013

STATEMENT OF FACTS

The applicant, Mr Daniel Liviu Litan , is a Romanian national, who was born in 1975 and is currently held in detention in Satu Mare Prison .

The facts of the case, as submitted by the applicant, may be summarised as follows.

The applicant was arrested on 18 May 2012 and is currently serving a prison sentence. He describes the overall conditions of detention as follows: overcrowding, lack of decent sanitary facilities, bedbug infestation in cells, insufficient warm water, food and outdoor exercise. In particular, from 18 to 22 May 2012 he was held in Satu Mare police detention facilities in a cell situated in the basement, without natural light and without a toilet. The inmates, 9 persons for a 25 sq. m cell, had to use a metal bucket for their necessities and the showers were placed above a dirty squat toilet. Since 22 May 2012 he has been held in various cells in Satu Mare Prison; the personal living space has been at all times between 1.23 sq. m and 1.65 sq. m. The cells are infested with bedbugs; warm water is only available twice per week for ten minutes per person. There is no space for storing food or personal items in the cell.

The applicant is currently sharing the cell with smokers although he does not smoke.

The applicant also describes the conditions in which he was transported from Satu Mare Prison to Oradea Prison in order to be heard by court. He mainly points to the lack of safety in the prison vehicles.

COMPLAINT

The applicant complains under Article 3 of the Convention about the conditions of his detention and transport between prisons .

QUESTIONS TO THE PARTIES

1. Are the conditions of the applicant ’ s detention in breach of the requirements of Article 3 of the Convention?

2. Are the conditions of the applicant ’ s transport between prisons in breach of the requirements of Article 3 of the Convention?

The Government are invited to provide information on the material conditi ons of detention and transport.
