Application no. 59646/13 Nelu VANCEA against Romania lodged on 30 July 2013

STATEMENT OF FACTS

The applicant, Mr Nelu Vancea, is a Romanian national, who was born in 1966 and is currently detained in Craiova Prison.

The facts of the case, as submitted by the applicant, may be summarised as follows.

On 21 December 2011 the applicant started serving in Craiova Prison his sentence of twelve years imprisonment for fraud.

The applicant alleges that he was subjected to very dire detention conditions, more specifically overcrowding, lack of adequate furniture and the presence of bugs in the cells and very poor quality food.

According to the medical chart drafted at the applicant ’ s placement in Craiova Prison, he was clinically healthy. On 14 June 2012 the applicant was diagnosed with metabolic syndrome, dyslipidaemia, second degree arterial hypertension and chronic steatosis hepatitis. He was recommended diet, treatment with hepatic-protective medicine and hospitalisation every three to six months. In this respect, the applicant submits that the medical treatment in Craiova Prison is of very poor quality and the supply in m edicine is often discontinued.

COMPLAINT

The applicant complains in substance under Article 3 of the Convention about the inhuman conditions of his detention in Craiova Prison, namely the overcrowding, lack of adequate furniture, poor hygiene and poor quality of food and the lack of medical assistance adequate to his health condition.

QUESTION TO THE PARTIES

Has the applicant been subjected to inhuman or degrading treatment, in breach of Article 3 of the Convention, on account of the conditions of his detention and the alleged lack of adequate medical assistance in Craiova Prison ?

The Government are invited to submit information concerning the conditions of the applicant ’ s detention in Craiova Prison , in particular as regards the alleged overcrowding, lack of adequate furniture in the cells, lack of hygiene and poor quality of food and medical treatment.
