Application no. 26634/14 Marius Zoltan SAS against Romania lodged on 28 April 2014

STATEMENT OF FACTS

The applicant, Mr Marius Zoltan Sas , is a Romanian national, who was born in 1974 and is currently serving a sentence in Baia Mare Prison .

The circumstances of the case

The facts of the case, as submitted by the applicant, may be summarised as follows.

On 13 December 2013 the applicant was placed in detention in order to serve an 18 months ’ prison sentence.

He spent the first two weeks in Baia Mare preventive detention centre and then was transferred to Baia Mare prison where he was held in various cells. According to the applicant ’ s overall description of the conditions in detention, he has been constantly held in overcrowded cells, the personal space varying between 2 sq. m and 2.6 sq. m. at all times. The cell s have very poor natural light or none at all and scarce possibility for air ing . The premises are dirty and infested with bedbugs and dust mites. The inmates are not given clean clothes and linen or personal hygiene products. The applicant further explains that, although according to the internal regulations the inmates are entitled to two hours of daily outdoor exercise, this is seldom the case, their outing being let completely at the wardens ’ discretion.

The applicant alleges that one of his current cellmates suffers from hepatitis and mental illness , posing a serious health and safety risk for the rest of the inmates .

Lastly, the applicant recounts that he was not examined by a physician when he was taken into detention and that for the first three weeks of detention he did not have any access to medical care .

COMPLAINT

The applicant complains under Article 3 of the Convention about the conditions of his detention .

QUESTION TO THE PARTIES

Were the conditions of the applicant ’ s detention in breach of the requirements of Article 3 of the Convention?

The Government are invited to provide information on the material conditions of detention.
