STATEMENT OF FACTS
THE FACTS [A1]
The applicant is an Iranian national who applied for asylum and a residence permit in Sweden . Before the migration authorities , he primarily claimed that he was homosexual and thus would risk persecution upon return to his home country. His application was finally rejected by the Migration Court of Appeal on 5 September 2014.
The applicant is represented before the Court by Mr S. Zebrowski , a lawyer practising in Uppsala .
COMPLAINT
The applicant complains under Article s 2 and 3 of the Convention that his expulsion from Sweden to Iran would expose him to a real risk of being sentenced to death or subjected to torture or ill-treatment because of his sexual orientation .
QUESTIONS
1. In the light of the applicant ’ s claims and the documents which have been submitted, would he face a risk of being subjected to treatment in breach of Articles 2 and/or 3 of the Convention if the expulsion order were enforced?
2. Does the applicant hold valid travel documents to enter Iran? If not, what is the reason for that and what has been done to obtain travel documents?
