QUESTION

Regard being had to the Court’s request of 20 April 2015 to provide additional documents from the criminal case-file concerning prosecution of the military authorities implicated in the Sknyliv aviation show accident and to comment on the independence of the experts engaged in the aviatio n expert assessment of 27 April 2004, does the Government ’ s failure to comply with the said request for over six months amount to Ukraine ’ s failure to furnish all necessary facilities for the examination of the above application, as required by Article 38 of the Convention?
