STATEMENT OF FACTS

FACTS

The applicant was born in 1988. He is represented before the Court by Ms E. David i yan and Ms D. Trenina , lawyers practicing in Moscow.

Since 23 August 2015 the applicant has been staying in the transit zone of Sheremetyevo airport in allegedly substandard conditions .

COMPLAINTS

1. The applicant complains that the conditions of his stay in the transit zone of Sheremetyevo airport are in breach of Article 3 of the Convention.

2. He further complains that he is de facto deprived of his liberty in breach of Article 5 § 1 of the Convention.

QUESTIONS TO THE PARTIES

1. Has there been a violation of Article 3 of the Convention in respect of the applicant on account of the allegedly poor material conditions of his stay in the transit zone of Sheremetyevo airport ?

2. Has the applicant been deprived of liberty within the meaning of Article 5 § 1 of the Convention? If so, has there been a violation of this provision (see Amuur v. France , 25 June 1996, §§ 38-54, Reports of Judgments and Decisions 1996 ‑ III)?
