FIFTH SECTION
Application no. 20160/16 Christine Ursula ZEMBOL against Germany lodged on 8 April 2016
SUBJECT MATTER OF THE CASE
The application concerns the right of the applicant to take notes during the hearings of the criminal trial against Oskar Gröning , a member of the SS who served as an accountant at the Auschwitz concentration camp, before the Lüneburg Regional Court in 2015, where he was charged with aiding and abetting 300,000 counts of murder. The applicant was admitted to the hearings as a member of the audience. The presiding judge ordered that members of the audience were not allowed to bring any object which could be used as a weapon, which was determined to include any writing utensil.
QUESTION tO THE PARTIES
Has there been an interference with the applicant ’ s freedom of expression, in particular her right to receive and impart information and ideas, within the meaning of Article 10 § 1 of the Convention? If so, was that interference prescribed by law and necessary in terms of Article 10 § 2?
