SUBJECT MATTER OF THE CASE

The application concerns the applicant ’ s penal conviction for insulting a university professor in the field of stem-cell research. The applicant, a campaigner against abortion and stem-cell research, published on-line critical statements on stem-cell research citing the name of a professor at the Bonn University. He referred to experiments on humans under the Nazi regime. Furthermore the applicant distributed leaflets with his statements. The domestic courts found a violation of the professor ’ s personality rights due to the reference to the Nazi regime and imposed 30 daily fines of 15 euros each on the applicant.

QUESTION tO THE PARTIES

Has there been a violation of the applicant ’ s right to freedom of expression, in particular his right to impart information and ideas contrary to Article 10 of the Convention?
