SUBJECT MATTER OF THE CASE

The application concerns the domestic courts ’ refusal of the applicant ’ s expropriation and compensation request for the remaining part of his motorway service facilities pursuant to Article 12 of the Expropriation Law (no. 2942) following the General Directorate of National Roads and Highways ’ s partial expropriation of them. The applicant complained that his damages stemming from the partial expropriation had not been thoroughly compensated.

QUESTIOn tO THE PARTIES

Has there been a violation of the applicant ’ s peaceful enjoyment of possessions, within the meaning of Article 1 of Protocol No.1 to the Convention due to the lack of compensation for the damages stemming from the partial expropriation of his motorway service facilities?
