Application no. 24047/13 Alin-Narcis GHIGA and Nicolae Catalin GABREA against Romania lodged on 26 March 2013

SUBJECT MATTER OF THE CASE

The application concerns the applicants ’ continuous filming by a video surveillance camera, while changing their clothes or coming out of the shower , between 27 February and 25 May 2009 during their pre-trial detention at the Sibiu Police Inspectorate. The applicants ’ complaint against the above-mentioned measure was rejected with final effect by the Sibiu County Court on 20 March 2013.

QUESTION tO THE PARTIES

Has there been an interference with the right to respect for the applicants ’ private life, within the meaning of Article 8 § 1 of the Convention, regarding their alleged continuous filming, by a video surveillance camera, during their pre-trial detention at the Sibiu Police Inspectorate between 27 February and 25 May 2009 ? If so, was this interference in accordance with the law and necessary in terms of Article 8 § 2 of the Convention (see Vasilic ă Mocanu v. Romania , no. 43545/13, § 40, 6 December 2016)?

T he Government are invited to provide information on the legal basis of the applicants ’ surveillance by video camera in the cells located on the police premises.
