STATEMENT OF FACTS
The applicants , A.G. and M.M., are Afghan nationals who had been living in Iran since they were minors. They lodged their asylum applications in the Netherlands in 2015. The applicants stated in this respect that they had been having an extramarital relationship as a result of which A.G. had become pregnant. Their child was born in the Netherlands . They are represented before the Court by Ms P. Kramer- Ograjensek , a lawyer practising in Sittard .
The applicants ’ asylum applications were rejected as their statements were disbelieved . Subsequently, steps were taken towards their removal from the Netherlands. During that process, however, it appeared that , as a result of the exchange of information between the Dutch and the Afghan authorities , the latter were provided with information showing that the applicants had a child together out of wedlock, which is a criminal offence under Afghan law.
The applicants complain that a return to either Iran or Afghanistan will subject them to treatment in violation of Article 3 of the Convention .
