SUBJECT MATTER OF THE CASE

The application concerns the expulsion of the applicant to the Philippines following his conviction to a prison sentence for aggravated drug trafficking. Referring to the “war on drugs”, he claims that he risks the death penalty, extralegal killing and a flagrant denial of justice if returned to the Philippines.

QUESTIONS tO THE PARTIES

1. Would the applicant ’ s ri ght to life, ensured by Article 2 of the Convention, be violated in case the expulsion order was implemented?

2. Would the implementation of the expulsion order give r ise to a violation of Article 3 of the Convention?

3. Has there been a violation of the procedural obligations under Article 2 and/or Article 3 due to the lack of formal decision concerning the allegations raised by the applicant?
