SUBJECT MATTER OF THE CASE

The application concerns the applicant ’ s alleged inability to participate in the investigation into the killing of his daughter on account of a court decision classifying the investigation file as confidential.

QUESTION tO THE PARTIES

Having regard to the procedural protection of the right to life (see Salman v. Turkey [GC], no. 21986/93, § 104, ECHR 2000-VII), was the investigation in the present case by the domestic authorities in breach of Article 2 of the Convention? In this connection, bearing in mind the decision to classify the investigation file as confidential, was the applicant able to effectively participate in the investigation to the extent necessary to safeguard his legitimate interests (see Güleç v. Turkey , 27 July 1998, § 82, Reports of Judgments and Decisions 1998 ‑ IV)?
