SUBJECT MATTER OF THE CASE

The application concerns the civil proceedings the applicant instituted against his employer under the Prevention of Discrimination Act ( Zakon o suzbijanju diskriminacije , Official Gazette no. 85/2008), alleging discrimination on the basis of his religion. The said Act provides for an appeal of points of law with the Supreme Court in all cases concerning allegations of discrimination. The present application concerns the applicant ’ s right of access to the Supreme Court under Article 6 § 1 of the Convention since his appeal on points of law was declared inadmissible.

QUESTIONs tO THE PARTIES

Was the applicant ’ s right of access to the Supreme Court violated contrary to Article 6 § 1 of the Convention. In particular, was the restriction on the applicant ’ s access to the Supreme Court foreseeable and proportionate?
