SUBJECT MATTER OF THE CASE
The application concerns the threatened expulsion of the applicant, a Congolese citizen who claims to be a member of the Movement for the Liberation of Congo , to the Democratic Republic of the Congo. On 14 March 2018 the Immigration and Asylum Office rejected the applicant ’ s asylum application for the third time and ordered his expulsion. It appears that the applicant ’ s asylum proceedings are still pending.
The applicant complains that his removal to Congo would put him at a serious risk of treatment in violation of Article 3 of the Convention.
On 28 March 2018 the Court indicated to the Government, under Rule 39 of its Rules, that the applicant should not be removed for the duration of the proceedings before the Court.
QUESTION tO THE PARTIES
In the light of the applicant ’ s claims and the documents which have been submitted, would he face a risk of being subjected to treatment in breach of Article 3 of the Convention if the expulsion order were enforced?
