SUBJECT MATTER OF THE CASE

The case concerns the same facts contained in application no. 30598/16 which was communicated on 25 June 2018 and is pending before the Court. It relates more specifically to the dismissal on 9 May 2018 of the complaint the applicant had lodged against a National Republican Guard, D.G., for alleged ill-treatment.

In the present case, invoking Article 3 of the Convention, the applicant complains of ill-treatment he suffered at the hands of D.G. and the domestic authorities ’ failure to conduct a prompt and effective investigation in this regard.

QUESTIONS tO THE PARTIES

1. Insofar as officer D.G. is concerned, has the applicant been subjected to inhuman or degrading treatment, in breach of Article 3 of the Convention ( Salman v. Turkey [GC], no. 21986/93, ECHR 2000-VI, and Bouyid v. Belgium [GC], no. 23380/09, ECHR 2015)?

2. Having regard to the procedural protection from inhuman or degrading treatment (see paragraph 131 of Labita v. Italy [GC], no. 26772/95, ECHR 2000-IV), was the domestic investigation into the charges of physical assault by D.G. in breach of Article 3 of the Convention?
