SUBJECT MATTER OF THE CASE

The application concerns the conditions of detention of the applicant, who is suffering from mental illness (chronic paranoid schizophrenia) and severe visual impairment, in view of his state of health.

The applicant complains under Article 3 of the Convention about the inadequacy of the conditions of his detention at Nicosia Central Prisons given his state of health and the fact that his complaints in this regard have not been examined. In particular, he complains about his detention in an ordinary prison, the State ’ s inability to deal with offenders with psychological problems and/or mental disorders and the lack of a suitable establishment for their detention. He also complains that in Block 4 he is daily subjected to degrading and humiliating treatment by the other prisoners. He claims that this has had a negative impact on his mental and psychological health and has led to the deterioration of his condition. The applicant also complains under Article 13 of a lack of an effective remedy for his Article 3 complaint.

QUESTIONS tO THE PARTIES

1. Has the applicant been subjected to inhuman or degrading treatment, in breach of Article 3 of the Convention, given his condition and the allegedly inapt circumstances of his detention?

2. Did the applicant have at his disposal an effective domestic remedy for his complaints under Article 3, as required by Article 13 of the Convention?
