Applications nos. 50702/17 and 79397/17 Gabi- Ainăld MIHĂILESCU against Romania and Iancu-Ștefan VASILE against Romania lodged on 21 August 2017 and 10 November 2017 respectively

SUBJECT MATTER OF THE CASE

The applications concern the applicants ’ complaints under Article 3 of the Convention concerning the lack of adequate dental care in prison, in spite of outstanding judgments given in their favour, holding the State authorities liable to provide them with appropriate medical treatment thereto (see appendix).

QUESTION TO THE PARTIES

Have the applicants been subjected to inhuman or degrading treatment, in breach of Article 3 of the Convention, in respect of the lack of adequate dental treatment, taking into account that the need for appropriate medical assistance thereto has been established in their case by the domestic courts via outstanding judgments which, according to the applicants, remained unenforced (see V.D. v. Romania , no. 7078/02, §§ 82-99, 16 February 2010)?
