SECOND SECTION

Application no. 9167/18 S.E. and Others against Norway lodged on 7 February 2018

SUBJECT MATTER OF THE CASE

The application concerns a decision that the municipality take a child into local authority care, withdraw the parents ’ parental responsibilities for the child, and authorise that the child be adopted by his foster parents.

Under Article 8 of the Convention, the applicants maintain that the above entailed a disproportionate interference with their right to respect for family life.

QUESTION tO THE PARTIES

Did the proceedings in which the applicant parents ’ child was taken into local authority care, their parental responsibilities in respect of the child removed and authorisation of the child ’ s foster parents ’ adopting him granted, entail a disproportionate interference with the applicants ’ right to respect for family life under Article 8 of the Convention? (See, for example, S.S. v. Slovenia , no. 40938/16, 30 October 2018; S.H. v. Italy , no. 52557/14 , 13 October 2015; Pontes v. Portugal , no. 19554/09, 10 April 2012; and Aune v. Norway , no. 52502/07, 28 October 2010 .)
