Application no. 23847/19 Evgheni TROCIN against the Republic of Moldova lodged on 12 April 2019

SUBJECT MATTER OF THE CASE

The application concerns the alleged ill-treatment of the applicant while in detention. The applicant was diagnosed with multiple bruises on his body. His complaint against the police officers who had allegedly ill-treated him was dismissed after being examined for more than four years. The applicant complains that he has been subjected to ill-treatment contrary to Article 3 of the Convention and that the authorities have failed to conduct an effective investigation into those allegations.

QUESTION TO THE PARTIES

1. Was the applicant subjected to ill-treatment in breach of Article 3 of the Convention ( Corsacov v. Moldova , no. 18944/02, 4 April 2006)?

2. Having regard to the procedural obligation under Article 3 of the Convention (see Labita v. Italy [GC], no. 26772/95, § 131, ECHR 2000-IV), was the investigation conducted in the present case by the domestic authorities in breach of the aforementioned provision?
