THIRD SECTION

Application no. 18568/19 Mohammad Ali JAFARI against Sweden lodged on 25 March 2019

STATEMENT OF FACTS

The application concerns an Afghan national who applied for a residence permit in Sweden on account of family ties to his father and two brothers. His application was rejected because the applicant had not sufficiently substantiated his identity.

The applicant complains that the Swedish authorities ’ refusal to grant him a residency permit violated his right to respect for his family life as guaranteed by Article 8 of the Convention.

QUESTION TO THE PARTIES

Has there been a violation of the applicant ’ s right to respect for his family life, contrary to Article 8 of the Convention? In particular, was the decision-making process fair, and did it afford due respect to the interests safeguarded by Article 8 (see Tanda-Muzinga v. France , no. 2260/10 , § 68, 10 July 2014 )?
