SECOND SECTION

Application no. 11181/19 Nesrin Y I LD I R I M against Turkey lodged on 1 February 2019

SUBJECT MATTER OF THE CASE

The application concerns the depreciation in value, due to the monetary inflation, of the expropriation compensation awarded to the applicant and the refusal of the Compensation Commission and the Constitutional Court to indemnify this loss.

QUESTIONS TO THE PARTIES

1. Has there been a violation of the applicants ’ peaceful enjoyment of possessions within the meaning of Article 1 of Protocol No. 1? In this context, was the interest rate applied to the expropriation compensation sufficient vis-à-vis the monetary inflation rates during the relevant period (see, Aka v. Turkey , 23 September 1998, Reports of Judgments and Decisions 1998 ‑ VI)?

2. What is the exact amount of the loss suffered by the applicant?
