SUBJECT MATTER OF THE CASE

The applicant, a former senior police officer, was initially acquitted of the charges of unlawful interference with the exercise of the right to peaceful protest but then convicted on appeal.

The c ourt of a ppeal refused to call witnesses Y.М.B., Y.B.A., N.G.M., P.O.P., P.Y.B., O.V.P . on whose evidence the trial court had relied in part in acquitting the applicant .

QUESTION S TO THE PARTIES

1. Did the applicant have a fair hearing in the determination of the criminal charges against him , in accordance with Article 6 § 1 of the Convention?

2. In particular, was the refusal to examine , in the appeal proceedings, Y.М.B., Y.B.A., N.G.M., P.O.P., P.Y.B. and O.V.P. , compatible with the requirements of Article 6 § 3 (d) of the Convention?
