SUBJECT MATTER OF THE CASE
The application concerns alleged ill-treatment of two journalists by private persons. The applicants complain of ineffectiveness of the criminal investigation and alleged failure by the State to comply with the positive obligation to protect their freedom of expression.
QUESTIONS TO THE PARTIES
1. H as there been a violation of the applicants ’ right to protection from ill-treatment with regard to the alleged attack and lack of an effective investigation by the domestic authorities, in breach of Article 3 of the Convention?
2. Has there been a violation of the applicants ’ right to freedom of expression, within the meaning of Article 10 of the Convention?
3. Did the applicants have at their disposal an effective domestic remedy for their complaints under Articles 3 and 10 of the Convention, as required by Article 13 of the Convention?
4. The Government are requested to submit copies of all documents in the domestic investigation file which are not currently available in the case file, including expert reports, witness statements, other evidence, decisions of domestic authorities and other documents.
