Application no. 59222/18 Tatyana Borisovna OKUSHKO and others against Cyprus lodged on 6 December 2018

SUBJECT MATTER OF THE CASE

The application concerns the death of the applicants ’ relative, Mr Rostislav Okushko in Cyprus. Mr Okushko , who was a Russian national, was found dead on 21 April 2017 in the bathroom of his apartment in Limassol.

The applicants listed in the appendix below are the wife (applicant no.1), two daughters ( applicants nos. 2 and 5) and the parents (applicants nos. 3 and 4) of the deceased. They are represented before the Court by Ms Oxana Preobrazhenskaya , a lawyer practising in Strasbourg.

The applicants complain that the Cypriot authorities failed to carry out an effective investigation into Mr Okushko ’ s death in violation of Articles 2 and 3 of the Convention. In this connection, they also complain that they were not kept informed about the course of the investigation .

QUESTION TO THE PARTIES

Bearing in mind the applicants ’ complaint and having regard to the procedural protection under Articles 2 and 3 of the Convention (see paragraph 104 of Salman v. Turkey [GC], no. 21986/93, § 104, ECHR 2000 ‑ VII and Labita v. Italy [GC], no. 26772/95, § 131, ECHR 2000-IV), was the investigation conducted in the present case by the domestic authorities effective in accordance with the above provisions?

In this connection the Government are also requested to clarify whether DNA tests were carried out on the knife found in the bathtub in the bathroom where Mr Okushko was found .
