STATEMENT OF FACTS
The applicant, Mr Pavel Aleksandrovich Yevstifeyev , is a Russian national, who was born in 1994 and is serving a prison sentence in the Vologda Region.
The circumstances of the case
The facts of the case, as submitted by the applicant, may be summarised as follows.
On 29 May 2017 the Ustyuzhna District Court of the Vologda Region found the applicant guilty of manslaughter and sentenced him to six years and nine months ’ conditional sentence.
On 1 August 2017 the Vologda Regional Court upheld the applicant ’ s conviction on appeal revoking his probation. The court heard the case in the applicant ’ s absence. His lawyer was present and made submissions to the court.
COMPLAINT
The applicant complains under Article 6 of the Convention about his absence from the appeal hearing.
QUESTIONS TO THE PARTIES
Did the applicant have a fair hearing in the determination of the criminal charges against him, in accordance with Article 6 §§ 1 and 3 (c) of the Convention? In particular, (1) did the applicant have an opportunity to attend the appeal hearing and (2) was it essential to the fairness of the proceedings that the applicant be present at the appeal hearing?
