SUBJECT MATTER OF THE CASE

The application concerns the alleged unfairness of the proceedings against the prison authorities regarding the applicant’s complaint about inefficient medical treatment.

The applicant complains that the domestic courts had not ensured his attendance at the hearings before the courts of higher instance .

QUESTIONS TO THE PARTIES

In the civil proceedings against the prison administration, did the applicant have a fair hearing in the determination of his civil rights and obligations, in accordance with Article 6 § 1 of the Convention? In particular, was the principle of equality of arms respected as regards the applicant ’ s personal presence at the hearings and examination of witnesses and other evidence?
