SUBJECT MATTER OF THE CASE

The application concerns the alleged lack of fairness of the criminal proceedings against the applicant who was convicted of hooliganism. She claims that despite her consistent requests the domestic courts failed to examine the allegedly available video of the incident and to summon the defence witnesses.

QUESTIONS TO THE PARTIES

Did the applicant have a fair hearing in the determination of the criminal charges against her, in accordance with Article 6 § 1? In particular, was the principle of equality of arms respected as regards the admission and examination of evidence? Was the applicant ’ s right to a reasoned decision respected? Was there any arbitrariness in the manner the domestic courts dealt with the evidence and/or applied the provisions of domestic criminal law under which the applicant was charged?
