Application no. 1020/20 Ion VLAD against Romania lodged on 16 December 2019

SUBJECT MATTER OF THE CASE

The application concerns non-enforcement of court decisions setting the contact schedule between the applicant and his child. Following the couple ’ s divorce, the parents shared parental responsibility, the mother was awarded custody of the child, and the applicant was granted contact rights. According to the applicant, the mother alienated the child from him and the authorities were not sufficiently active to help him restore his relationship with his child.

QUESTIONS TO THE PARTIES

1. Has there been a violation of the applicant ’ s right to respect for his f amily life, contrary to Article 8 of the Convention?

In particular, have the authorities (child protection authority, bailiff ’ s office, police, and domestic courts) provided sufficient assistance to the applicant for the enforcement of the domestic decisions granting him contact rights with his child: the decision no. 9531 of 14 November 2013 of the Bucharest District Court of the Fifth Precinct (file no. 12492/302/2012) and the decision no. 1738 of 25 October 2016 of the G ă e ş ti District Court (file no. 9356/302/2015)?

2. The parties are invited to submit information on the new proceedings concerning the custody and contact rights, which were pending before the Găeşti District Court (file no. 2256/232/2018).
