SUBJECT MATTER OF THE CASE

The application concerns the criminal conviction of the applicant for defamation of Th. G. and M.V. The applicant had appeared on national television on 13 December 2005 making allegations for the way they had exercised their duties as guardians of V.P. The guardians were later removed from their duties due to acts and omissions which had not served the best interests of V.P. and were convicted for embezzlement ( απιστία ).

QUESTION TO THE PARTIES

Has there been a violation of the applicant ’ s right to freedom of expression to Article 10 of the Convention on account of his criminal conviction for defamation following his appearance on national television on 13 December 2005?
