SUBJECT MATTER OF THE CASE

The application concerns the applicant ’ s conviction on the extremism charges under Article 280(1) of the Criminal Code for having commented on a publication about an anti-terrorist operation in the Eastern Ukraine, “Death to the occupiers from the Kremlin! Hands off Ukraine!” The applicant was given a two-year prison sentence (final decision: 28 July 2016, the Astrakhan Regional Court).

QUESTIONS TO THE PARTIES

Has there been a violation of Article 10 of the Convention? Was the applicant ’ s conviction based on clear and foreseeable legal provisions and necessary in a democratic society? In particular, was the sentence proportionate to the gravity of his acts?
