SUBJECT MATTER OF THE CASE

The applicant, a major broadcasting company in Serbia, complains under Article 10 of the Convention of a breach of its freedom of expression. Specifically, the applicant company maintains: ( i ) that its TV reports, as well as the internet articles in question, legitimately raised very serious issues to do with corruption in the public procurement of vaccines regarding the H1N1 pandemic in 2009; and (ii) that it was ultimately punished for so doing by losing a civil defamation case and being ordered to pay compensation plus costs to the plaintiff.

QUESTION TO THE PARTIES

Has there been a violation of the applicant company ’ s right to freedom of expression, in particular its right to impart information and/or ideas, contrary to Article 10 of the Convention?
