SUBJECT MATTER OF THE CASE
The application concerns an international child abduction and the alleged failure of the State to comply with its positive obligations under Article 8 of the Convention.
The applicant complains under Article 8 of the Convention that her and her child ’ s right to private life have been violated as, inter alia, the domestic courts failed to adequately apply the Convention and the Hague Convention on the Civil Aspects of International Child Abduction of 25 October 1980 standards and to adequately assess the situation and the risks involved.
In addition, the applicant complains under Article 8 of the Convention about the length of the domestic proceedings.
QUESTION TO THE PARTIES
Has there been a violation of the applicant ’ s right to respect for her private and family life, contrary to Article 8 of the Convention? Did the domestic authorities comply with the requirement of speediness inherent in the proceedings under the Hague Convention on International Child Abduction (see X v. Latvia [GC], no. 27853/09, §§ 93-108, 107 ECHR 2013, and G.N. v. Poland , no. 2171/14, §§ 47-48 and 66-68, 19 July 2016 )?
