SUBJECT MATTER OF THE CASE
The cases concern the termination of the applicants’ employment contracts on account of the alleged existence of links with a terrorist organisation on the basis of the simplified dismissal procedure as set out in the emergency legislative decree no. 667 . The cases raise issues similar to those examined in PiÅŸkin v. Turkey (no. 33399/18, §§ 129-153 and §§ 167 ‑ 229, 15 December 2020).
The applicants complain that their right to a fair trial, including their right to an effective examination of their case, were breached before the domestic courts. The applicants in applications nos. 8057/19, 8467/19, 9041/19, 24205/19 and 27855/20 further complain under Article 8 of the Convention of the detrimental consequences of the dismissal on their reputation and their private lives.
QUESTIONS TO THE PARTIES
1. In the light of the principles set out in PiÅŸkin v. Turkey (cited above, §§ 120 ‑ 153), did the domestic courts carry out an effective judicial review of the applicants’ dismissals in accordance with Article 6 § 1 of the Convention?
2. Has there been a violation of Article 8 of the Convention in respect of the applicants in application nos. 8057/19, 8467/19, 9041/19, 24205/19 and 27855/20 (see, Pişkin , cited above, §§ 211-229)?
