THIRD SECTION
Application no. 20558/21 Yan Nikolayevich KATELEVSKIY against Russia lodged on 13 March 2021 communicated on 3 September 2021
SUBJECT MATTER OF THE CASE
The application concerns the domestic courts’ alleged failure to adduce relevant sufficient reasons justifying the extension of the applicant’s pre ‑ trial detention since 29 July 2020 as well as an alleged breach of his right to presumption of innocence on account of the unqualified character of the statement made by the Ramenskiy Town Court of Moscow Region in its extension order of 19 August 2020, which amounted to a pronouncement on his guilt before he was proved guilty according to law (see Vakhitov and Others v. Russia , nos. 18232/11 and 2 others, §§ 69-71, 31 January 2017).
QUESTIONS TO THE PARTIES
1. Was the length of the applicant’s pre-trial detention in breach of the “reasonable time” requirement of Article 5 § 3 of the Convention?
2. Was the presumption of innocence, guaranteed by Article 6 § 2 of the Convention, respected in the present case as regards the impugned statement made by the Ramenskiy Town Court of the Moscow Region in its decision of 19 August 2020 (see Vakhitov and Others v. Russia , nos. 18232/11 and 2 others, §§ 69-71, 31 January 2017)?
