Execution of the judgment of the European Court of Human Rights

(Application No. 32476/06, judgment of 2 September 2010, final on 21 February 2011)

The Committee of Ministers, under the terms of Article 46, paragraph 2, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of final judgments of the European Court of Human Rights (hereinafter “the Convention” and “the Court”),

Having regard to the final judgment transmitted by the Court to the Committee in the above case and to the violation established (see document DH-DD(2 0 12)638F ) [2] ;

Recalling that the respondent State ’ s obligation under Article 46, paragraph 1, of the Convention to abide to by all final judgments in cases to which it has been a party and that this obligation entails, over and above the payment of any sums awarded by the Court, the adoption by the authorities of the respondent State, where required:

- of individual measures to put an end to violations established and erase their consequences so as to achieve as far as possible restitutio in integrum ; and

- of general measures preventing similar violations;

Having invited the government of the respondent State to inform the Committee of the measures taken to comply with its above-mentioned obligation;

Having examined the action report provided by the government indicating the measures adopted in order to give effect to the judgment and noting that no award of just satisfaction was made by the Court in the present case (see document DH-DD(2012)638F );

Having satisfied itself that all the measures required by Article 46, paragraph 1, have been adopted;

DECLARES that it has exe r cised its functions under Article 46, paragraph 2, of the Convention in this case and

DECIDES to close the examination thereof.

Bilan d ’ action

Cette affaire concerne le risque pour les requérants, ressortissant biélorusses, d ’ être soumis à des traitements contraires à l ’ article 3 de la Convention s ’ ils étaient éloignés, "à l ’ heure actuelle", à destination de la Biélorussie.

La Cour n ’ a alloué aucune satisfaction équitable aux requérants.

2. Les autres mesures éventuelles

Suite à l ’ arrêt de la Cour , et la demande des requérants en date du 23 janvier 2012 visant à obtenir la régularisation de leur situation, l ’ administration leur a délivré dès le 6 février 2012 un récépissé de demande de titre de séjour « vie privée et familiale ». A la date d ’ échéance du récépissé, M. et Mme YP LP recevront une carte de séjour renouvelable d ’ un an portant la mention « vie privée et familiale ».

La délivrance de ce récépissé a eu pour effet d ’ abroger les mesures de reconduite vers la Biélorussie dont ils avaient fait l ’ objet.

L ’ arrêt a été publié sur le site internet de la Cour de cassation (septembre 2010, n o 33). Il a également été diffusé sur le site intranet de la juridiction administrative à l ’ attention des magistrats et du personnel du greffe (septembre 2010). Il est par ailleurs disponible par l ’ intermédiaire de la base de données grand public « Légifrance ».

L ’ exécution de cet arrêt n ’ appelle pas d ’ autres mesures générales.

Le Gouvernement considère par conséquent que l ’ arrêt a été exécuté.
