Application no. 26161/20 Yelena Valeryevna MILASHINA against Russia

The European Court of Human Rights (Third Section), sitting on 10 November 2022 as a Committee composed of:

Having regard to the above application lodged on 23 March 2020,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant, Ms Yelena Valeryevna Milashina, was born in 1977. She was represented by Mr A. Karavayev, a lawyer practising in Nizhniy Novgorod.

The applicant’s complaints under Articles 6, 10 and 11 of the Convention were communicated to the Russian Government (“the Government”).

The applicant was invited to submit her observations on the admissibility and merits of the application by 15 July 2022. The observations had not been submitted within that time-limit. By letter of 11 August 2022, the applicant’s representative informed the Court that he had had no contact with the applicant since February 2022, that she had left Russia and that her current address was not known.

THE LAW

As the applicant failed to keep her representative updated of her contact details, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application.

Accordingly, the case should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.
