Application no. 55155/09 Igor Nikolayevich SUKHIN and Others against Russia

Having regard to the above application lodged on 21 September 2009,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The list of the applicants is set out in the appendix.
The applicants’ complaints under Article 10 § 1 of the Convention concerning a disproportionate interference with their freedom of expression were communicated to the Russian Government (“the Government”), who submitted observations on the admissibility and merits. The observations were forwarded to the applicants, who were invited to submit their own observations. No reply was received to the Registry’s letter.
By letter dated 13 January 2020 , sent by registered post, the applicants were notified that the period allowed for submission of their observations had expired on 13 November 2019 and that no extension of time had been requested. The applicants’ attention was drawn to Article 37 § 1 (a) of the Convention, which provides that the Court may strike an application out of its list of cases where the circumstances lead to the conclusion that the applicant does not intend to pursue the application. The applicants received this letter on 10 February 2020. However, no response followed.
On 1 February 2021 a letter was received from one of the applicants, in which he informed the Court about their representative’s death in 2016. By letters of 24 February 2021, sent by registered post, the applicants were notified about a new time-limit granted for submitting their written observations together with their claims for just satisfaction. However, no reply has been received.
By letters dated 8 July 2021, sent by registered post, the applicants were notified that the period allowed for submission of their observations had expired on 26 April 2021 and that no extension of time had been requested. The applicants’ attention was drawn to Article 37 § 1 (a) of the Convention, which provides that the Court may strike an application out of its list of cases where the circumstances lead to the conclusion that the applicant does not intend to pursue the application. Two of the applicants received these letters on 13 August 2021. However, no response followed. The letters to the other applicants were not claimed by them and were sent back to the Court on 1 September 2021.
THE LAW
In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application.
Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
