DECISION

Application no. 53548/17 Stepan Vasylyovych CHEREVKO against Ukraine

The European Court of Human Rights (Fifth Section), sitting on 24 March 2022 as a Committee composed of:

Lətif Hüseynov, President, Lado Chanturia, Arnfinn Bårdsen, judges,

and Viktoriya Maradudina, Acting Deputy Section Registrar,

Having regard to the above application lodged on 12 July 2017,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant, Mr Stepan Vasylyovych Cherevko, is a Ukrainian national, who was born in 1993 and lives in Vinnytsya. He was represented before the Court by Mr O.V. Biloshkurskyy, a lawyer practising in Vinnytsya.

The applicant’s complaints under Articles 4 and 8 of the Convention concerning the extension of his military service contract contrary to his will were communicated to the Ukrainian Government (“the Government”), who were represented by their Agent, Ms. O. Davydchuk, of the Ministry of Justice.

The applicant failed to respond to the last Registry’s letters of 12 January 2022 (received by his representative on 28 January 2022 and by the applicant himself on 31 January 2022), reminding him that the period allowed for submission of his reply to the Government’s observations had expired on 16 December 2021 and that no extension of time had been requested. His attention was drawn to Article 37 § 1 (a) of the Convention.

THE LAW

In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application.

Accordingly, the case should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.
