SECOND SECTION

DECISION

Ljiljana SAVOVIĆ against Serbia

and Milan KOVAČEVIĆ against Serbia

(see appended table)

The European Court of Human Rights (Second Section), sitting on 22 September 2022 as a Committee composed of:

Jovan Ilievski , President,

Gilberto Felici ,

Diana Sârcu , judges,

and Viktoriya Maradudina, Acting Deputy Section Registrar,

Having regard to the above applications lodged on 7 March 2022,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The list of the applicants is set out in the appendix.

The applicants were represented by Mr. R. Kojić, a lawyer practising in Belgrade.

The applicants’ complaints under Article 6 § 1 of the Convention and Article 1 of Protocol No. 1 concerning the non-enforcement or delayed enforcement of domestic decisions given against socially/State-owned companies were communicated to the Serbian Government (“the Government”)

On 29 August 2022 the applicants informed the Registry that they wanted to withdraw their applications to the Court since they had obtained redress at the domestic level.

THE LAW

In the light of the foregoing, the Court concludes that the applicants may be regarded as no longer wishing to pursue the applications (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the applications.

For these reasons, the Court, unanimously,

Decides to strike the applications out of its list of cases.

Done in English and notified in writing on 13 October 2022.

Viktoriya Maradudina Jovan Ilievski Acting Deputy Registrar President
