DECISION
Application no . 66435/12 Ivan BASTALIĆ against Croatia
The European Court of Human Rights (First Section), sitting on 19 February 2013 as a Committee composed of:

Having regard to the above application lodged on 10 September 2012,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicant, Mr Ivan Bastalić , is a Croatian national, who was born in 1953 and lives in Zagreb .
The Croatian Government (“the Government”) were represented by their Agent, Ms Š. Stažnik .
The applicant complained under Articles 3 and 13 of the Convention about the conditions of his detention in Zagreb Prison and about the lack of an effective remedy in that respect.
On 13 November 2012 the Court decided to give notice to the Government of the applicant ’ s complaints detailed above.
On 10 December 2012 the applicant informed the Court that he wanted to withdraw the application since his conditions had been completely changed and he had no reason to pursue his complaints before the Court.
THE LAW
In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention or its Protocols, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application.
Accordingly, the case sh ould be struck out of the list.
For these reasons, the Court unanimously
Decides to strike the application out of its list of cases.
