Having regard to the above application lodged on 13 August 2007,
Having deliberated, decides as follows:
THE FACTS
The applicant, Mr Ion Constantin , was a Romanian national, who was born in 1970 and was detained in Ploiesti Prison.
The Romanian Government (“the Government”) were represented by their Agent, Ms Catrinel Brumar , from the Ministry of Foreign Affairs.
The applicant complained about his conditions of detention not adapted to his heart illness.
The Registry ’ s letters of 20 February 2008 and 14 January 2009 requesting additional documents from the applicant remained unanswered.
After the communication of the application, the Government informed the Court that the applicant, who had been released from prison, died in a car accident on 30 November 2007 in his home town. The Government submitted a copy of the death certificate in this respect.
Since the last correspondence with the applicant on 17 September 2007, the Registry did not receive any request from another person to pursue the application on behalf of the applicant.
THE LAW
The Court considers that, under these circumstances and in accordance with Article 37 § 1 (c) it is no longer justified to continue with the examination of the application. Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and its Protocols which require the continued examination of the case.
In view of the above, it is appropriate to strike the case out of the list.
For these reasons, the Court unanimously
Decides to strike the application out of its list of cases.
