Application no. 2614/04 Iryna Vlasivna NAKALYUZHNA against Ukraine and 7 1 other applications (see list appended)

Having regard to the above applications lodged on the various dates stated in the annexed table,
Having regard to the decision to apply the pilot-judgment procedure taken in the case of Yuriy Nikolayevich Ivanov v. Ukraine , no. 40450/04 , 15 October 2009,
Having deliberated, decides as follows:
THE FACTS
The applicants are Ukrainian nationals, except for the applicants in applications nos. 17631/07 and 50344/07, who are respectively Moldovan and Russian nationals. Applicants in the applications nos. 17516/04 and 8062/09 are legal entities registered in Ukraine. Personal details of all the applicants are set out in the annexed table.
The Ukrainian Government (“the Government”) were represented by their Agent, Mr Nazar Kulchytskyy, of the Ministry of Justice.
The facts of the case, as submitted by the parties, may be summarised as follows.
On the dates set out in the annexed table below the national courts held for the applicants and ordered the defendants under these judgments (debtors) to take certain measures or to pay various amounts to the applicants. The judgments became binding but the authorities delayed their enforcement.
The applications were communicated to the Ukrainian Government within the pilot judgment in the case of Yuriy Nikolayevich Ivanov cited above.
COMPLAINTS
The applicants complained principally about the lengthy non ‑ enforcement of judgments in their favour.
THE LAW
The Court first considers that in accordance with Rule 42 § 1 of the Rules of Court, the applications listed in in the appended table should be joined, given their common legal background.
The respondent Government informed the Court that the applications did not comply with the admissibility criteria of the Convention and thus invited the Court to declare them inadmissible.
The applicants disagreed.
The Court has carefully examined the applications and notes that in each case the communicated non-enforcement complaints are inadmissible on the grounds set out in the annexed table (see last column) .
The Court further notes that, in the light of all the material in its possession, and in so far as the matter complained of is within its competence, all the other complaints of the applicants do not disclose any appearance of a violation of the rights and freedoms set out in the Convention or its Protocols.
It follows that all the applications listed in the annexed table are manifestly ill-founded and must be rejected in accordance with Article 35 §§ 1, 3 and 4 of the Convention.
For these reasons, the Court unanimously
Decides to join the applications;
Declares the applications inadmissible.
