Application no . 47743/09 Dan Mugur DRĂGHIA against Romania

The European Court of Human Rights ( Third Section ), sitting on 20 January 2015 as a Committee composed of:

Dragoljub Popović , President, Kristina Pardalos , Valeriu Griţco , judges,

and Marialena Tsirli , Deputy Section Registrar ,

Having regard to the above application lodged on 26 August 2009 ,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant, Mr Dan Mugur Drăghia , is a Romanian national, who was born in 1964 and lives in Brăila .

The Romanian Government (“the Government”) were represented by their Agent, Ms C. Brumar , from the Ministry of Foreign Affairs .

The applicant complained under Article 6 § 1 of the Convention and Article 1 of Protocol No. 1 to the Convention about the state authorities ’ failure to enforce the final judgment rendered in h is favour .

On 11 September 2012 the Government submitted to the Registry their observations on the admissibility and merits of the application. These were forwarded on 25 October 2012 to the applicant, who was invited to submit by 6 December 2012 his claims for just satisfaction .

On 3 December 2012 the applicant informed the Court that he wanted to withdraw the application .

B y letter dated 16 September 2014, sent by registered post, the applicant was asked to confirm that he wanted to withdraw the application . The letter was returned to the Court as unclaimed.

THE LAW

In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention or its Protocols, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application.

Accordingly, the case should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.

Done in English and notified in writing on 12 February 2015 .
