DECISION

Application no . 14618/08 Aleksandr Viktorovich ANANYEV and others against Russia

The European Court of Human Rights (First Section), sitting on 6 October 2015 as a Committee composed of:

Khanlar Hajiyev, President, Julia Laffranque, Dmitry Dedov, judges, and André Wampach, Deputy Section Registrar ,

Having regard to the above application lodged on 21 January 2008,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

1. A list of the applicants is set out in the appendix.

2. The Russian Government (“the Government”) were represented by Mr G. Matyushkin, Representative of the Russian Federation at the European Court of Human Rights.

3. The facts of the case, as submitted by the parties, may be summarised as follows.

4. In 2003 the applicants bought a flat from a private person.

5. On an unspecified date the prosecutor ’ s office, acting on behalf of the Moscow Housing Department, brought a claim against the applicants seeking, inter alia , the restitution of the title to the flat to the municipality and the applicants ’ eviction.

6. On 6 April 2007 the Kuzminskiy District Court of Moscow granted the prosecutor ’ s claim.

7. On 24 July 2007 the Moscow City Court upheld the judgment of 6 April 2007 on appeal.

8. On 13 January 2009 the Supreme Court of the Russian Federation quashed the judgments of 6 April 2006 and 24 July 2007, by way of supervisory review, and remitted the matter for fresh examination.

9. On 11 February 2009 the District Court rejected the prosecutor ’ s claims against the applicants. On 3 March 2009 the relevant judgment entered into force.

10. On 17 February 2014 the applicants informed the Court that the dispute had been resolved in their favour and they wanted to withdraw the application.

THE LAW

11. In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention or its Protocols, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application.

12. Accordingly, the case should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.
