DECISION

Application no . 47247/07 OOO IVPRESS against Russia

The European Court of Human Rights (First Section), sitting on 6 October 2015 as a Committee composed of:

Elisabeth Steiner, President, Paulo Pinto de Albuquerque, Erik Møse, judges,

and André Wampach, Deputy Section Registrar ,

Having regard to the above application lodged on 12 September 2007,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant, OOO Ivpress, is a Russian limited-liability company with the registered office in Ivanovo.

The Russian Government (“the Government”) were represented by Mr G. Matyushkin, Representative of the Russian Federation at the European Court of Human Rights.

The applicant alleged a violation of Article 10 of the Convention in relation to a defamation case before the domestic courts.

On 27 August 2010 the Court decided to give notice to the Government of the applicant ’ s complaint detailed above. On 22 December 2010 the Government submitted to the Registry their observations on the admissibility and merits of the application. Thereafter, the applicant submitted observations in reply. On 18 February 2015 the applicant company informed the Court that they wanted to withdraw the application.

THE LAW

In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention or its Protocols, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application.

Accordingly, the case should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.
