DECISION

Application no . 41251/04 Veronica DAIANU and Liselotte FISCHER against Romania

The European Court of Human Rights (Fourth Section), sitting on 8 December 2015 as a Committee composed of:

Nona Tsotsoria , President, Krzysztof Wojtyczek, Gabriele Kucsko-Stadlmayer , judges,

and Fatoş Aracı , Deputy Section Registrar ,

Having regard to the above application lodged on 26 August 2004,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicants, Ms Veronica Daianu and Ms Liselotte Fischer, are Romanian nationals, who were born in 1947 and 1922 respectively and live in Bucharest. They were represented before the Court by Mr P. Tita , a lawyer practising in Bucharest.

The Romanian Government (“the Government”) were represented by their Agent, Ms C. Brumar , of the Ministry of Foreign Affairs.

The applicants complained under Article 1 of Protocol No. 1 to the Convention that their prolonged inability to use property over which they held a valid title entailed a breach of their right to the peaceful enjoyment of their possession.

On 1 September 2006 the Court decided to give notice to the Government of the applicants ’ complaint detailed above.

On 15 January 2015 the applicants ’ representative informed the Court that the applicants wanted to withdraw the application since the matter complained of had been resolved by the domestic authorities.

THE LAW

In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention or its Protocols, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application.

Accordingly, the case should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.
